Costa Mesa resident Eleanor Egan wants a court to get rid of part or all of the rebuttal for a citizen-sponsored initiative that would require voter approval for some local developments.

Egan’s argument, as stated in documents filed July 7 in Orange County Superior Court, is that several statements against Measure Z are misleading, according to the Orange County Register.

She also claims some of the statements are outright false or incapable of being proven true.

Included in these claims is Measure Z, the proposed Costa Mesa First Initiative, would increase traffic, is unconstitutional and would require votes on new restaurants and Starbucks Coffee drive-thrus, according to Egan.

Other Costa Mesa residents, who had signed the rebuttal argument, are named in the court documents. They include Costa Mesa City Councilman Jim Righeimer, Julie Fowler, Chuck Perry, Lee Ramos and Christopher Bunyan.

Righeimer helped author the rebuttal. City officials are not commenting on the pending legislation.
