Kushner Cos. Sued By Times Square Food Hall Tenant Todd English

A Portion Of The Retail Condo At 229 West 43Rd St. In New York As Of November 2017

Once again, Kushner Cos. finds itself in a legal fight — this time with a celebrity chef.

Outstanding Hospitality Management, the restaurant company founded by Todd English, filed a lawsuit against the developer run by the family of Jared Kushner over a lease for a food hall in Times Square, Bloomberg reports.

According to the suit, English, who hosts the PBS show "Food Trip with Todd English," planned a Roaring '20s-themed champagne bar and food hall in a 1,900 SF space at 229 West 43rd St., where Kushner Cos. owns the retail condo. Kushner allegedly told OHM that it would be sharing the space with another tenant, which OHM claims violates the terms of the lease, according to Bloomberg.

Kushner alleges that OHM had not paid rent for February and missed a deadline to open agreed upon in the lease, and thus were in default. The landlord had been planning to file its own suit against OHM for violating the lease, Kushner spokesman Chris Taylor told Bloomberg.

The lawsuit is at least the fourth open civil case against Kushner Cos., with two rent control abuse suits in Brooklyn and a tenant harassment suit in Maryland already on the docket. Beyond those lawsuits, Kushner Cos. is also facing public and legal scrutiny over a laundry list of concerns, some having to do with former CEO Jared Kushner's actions before and after departing for his senior adviser position at the White House.
