A developer has added extra height to a proposed building in SoHo, while pursuing legal action against a nearby development for being too tall.

Madigan Development originally filed plans in 2015 for a 15-story tower combining residential units and ground-floor retail at 111 Varick St. — plans that were approved in May. On Friday, Madigan submitted a new plan for a 27-story, 337-foot tower at the site, comprising 1,785 SF of retail space below 101 residential units likely to be condos, NY Yimby reports.

Previously, Madigan had filed suit against Agime Group alleging that the latter's project at 570 Broome St. was only zoned for 185 feet, and that an exemption granted by the New York City Department of Buildings allowing for 290 feet of construction is illegitimate, The Real Deal reports. Agime Group is countersuing, claiming that contesting 570 Broome's zoning violates 111 Varick's own zoning agreement.

The dueling projects are near the Holland Tunnel, a decent walk removed from the retail-focused heart of SoHo.
