A lawsuit filed last week in Denver District Court threw up the latest hurdle for proposed development on 155 acres of Denver infill space at the former Park Hill Golf Course at Colorado Boulevard and 35th Avenue.

Save Open Space Denver, a group that advocates the preservation of the former links as open space, filed the suit in an attempt to maintain a 2019 conservation easement that would prevent development on the East Denver site as “protected land,” according to The Denver Post.

A question that would allow the vacation of that easement is on the April 4 municipal ballot. If voters pass the measure, developer Westside Investment Partners could proceed with its plans for the land, including up to 3,200 new housing units and retail. The latest iteration of Westside’s plan preserves nearly two-thirds of the land as a park.

But the preservation group argues there is “taxpayer standing to seek to enjoin the unlawful expenditure of public lands and disposition of a valuable taxpayer funded real estate asset owned by the city for the benefit of its residents.”

A Delaware-based affiliate of Westside purchased the property from Clayton Early Learning in 2019 for $24M, and the debate over developing the land has been waged ever since.
