A Connecticut casino is the latest critic of a Wynn Resorts deal with the Massachusetts Gaming Commission to operate a casino in Boston, and it wants Wynn’s operating license tossed out.

Mohegan Sun filed documents this week in Suffolk Superior Court and asked a judge to throw out the Greater Boston casino license Wynn Resorts was awarded four years ago from the MGC. Mohegan argues the gaming board failed to properly vet the casino company and its former CEO, Steve Wynn, who has been accused of decades of sexual misconduct, the Boston Herald reports.

The court documents also asked the judge to amend a 2015 complaint the Connecticut casino company had, arguing it was never given a fair shot at obtaining the Boston area casino license for itself. The new complaint argues the MGC’s inability to find accusations of Steve Wynn’s sexual misconduct that preceded its 2014 background check into his company shows bias in favor of Wynn.

“Wynn’s failure to disclose this information, and the Commission’s inability to uncover information that was, by all accounts, hiding in plain sight, raises significant questions regarding the scope of the suitability review of Wynn and goes to the heart of Plaintiff's claim that the Commission was irrevocably biased in favor of the Wynn application,” Mohegan said in its complaint.

The MGC is currently underway with an investigation into how much Wynn executives knew about the behavior and accusations against its fallen leader. While Steve Wynn has since stepped down and the name of the casino under construction outside Boston has since been changed to Encore Boston Harbor, there is still a possibility the license to operate the $2.5B casino will be revoked.
