Lawsuit Filed Against City Over Affordable Housing Requirements

The Home Builders Association of Greater Chicago and Hoyne development have filed suit against the city over its affordable housing requirements. The suit claims that the Affordable Requirements Ordinance is unconstitutional and violates the Fifth Amendment because it takes private property without “just compensation.” The city views the suit as having no merit and plans to vigorously defend the ordinance. The suit specifically applies to a former Ford dealership that Hoyne purchased and rezoned for condos and apartments. The suit alleges the city wrongfully applied the ordinance to the project, which would have forced the developer to provide affordable units or pay a fine. The ordinance was passed in 2003 and updated in 2007. A stricter version of the ordinance has been passed and is set to take effect in October. [Trib]
