Peruvian Billionaire Who Wouldn’t Share Penthouse Terrace May Get Deposit Back

Carlos Rodriguez Pastor, a Peruvian billionaire, backed out of his purchase of a $27.5M penthouse at 1107 Fifth Ave because he’d have to share the terrace space. On Tuesday, a Manhattan court said there’s a chance he could get his $2.75M deposit back. In a court affidavit quoted by the NY Daily News, he claims that the pad wasn’t marketed to indicate there’d be a staircase puncturing the terrace. The co-op board of the building wouldn’t guarantee that the roof would be forever private, so the billionaire backed out of the deal. [NYDN]
