Work on Piers 92 and 94 can move forward again. Congrats to Fried Frank’s Rick Leland (above), David Pollack, and Mark Siegmund, who obtained an appellate litigation victory on behalf of Vornadoaffiliate Merchandise Mart Properties. The First Department of the Supreme Court annulled a lower court ruling in Hells Kitchen Neighborhood Association, et al. v. The City of New York, et al.,reinstating approvals granted by the City Department of Small Business Services, the City Planning Commission, and the City Council. That means Merchandise Mart can lease, renovate, and update the 75k SF Pier 92 and the 133k SF Pier 94 between W 52nd and W 55th Sts. The Appellate Division found that the environmental review for the project was proper and that an Environmental ImpactStatement was not required. Rick and colleagues Stephen Lefkowitz, Carol Rosenthal, and Zachary Bernstein also repped Merchandise Mart in the underlying approvals.
