New Judge To Bring Resolution To Montrose Management District Case

A new judge is presiding over the 2012 case against the legality of the Montrose Management District. State District Judge Daryl Moore in Harris County's 333rd Civil Court said he will continue to study the details of the case before making his ruling, the Houston Chronicle reports. Judge Moore inherited the case from Judge Tad Halbach Jr, who retired before issuing a final ruling.

Another lawsuit against the district making similar claims is set be to heard by U.S. District Judge Alfred Bennett in federal court on May 26. Montrose Management District has continually defended its legality, citing earlier court rulings in its favor. The district also claims property owners are not entitled to a refund of the district's assessments because the plaintiffs have failed to prove the funds were paid under duress.
