A contractor working on an air-rights project near Fenway Park has sued the developer and the state, alleging millions in unpaid bills.

Framingham-based J.F. White Contracting Co. claims it is owed more than $27M for the work it provided on IQHQ's Fenway Center project in Boston, according to an Aug. 27 court filing. The suit names IQHQ and the Massachusetts Department of Transportation as defendants, Law.com first reported.

The company signed a contract with the life sciences developer in 2021 stating that it would build the foundation structures and decking above the state-owned Massachusetts Turnpike.

The contracting company is requesting that a Suffolk Superior Court judge award it the money, plus interest and costs associated with the lawsuit. The original work on the project was estimated to cost $130M, but it ended up totaling $141M, according to the suit, which the Boston Business Journal reported Thursday.

IQHQ didn't respond to Bisnow's request for comment, and MassDOT declined to comment on active litigation.

The Fenway Center air rights project is one of a few projects being built over the Mass Pike, including Samuels & Associates' Lyrik, which opened last year.

The multiphase project is slated to include two residential towers totaling 312 units and a 22-story office and lab tower that will stand over the highway. Construction on the air rights project began in 2021.

IQHQ, a national life sciences developer, is working on several other projects in the Boston area, including a nearby life sciences project on the site of the former Hotel Buckminster in the Fenway area.
