FCC chairman Tom Wheeler's recent speech on market-based cybersecurity policy may foretell some kind of reporting program for ISPs from the FCC, says Venable telecom co-chair and cybersecurity partner Jamie Barnett. It's a significant change from what's happening now, but also a far cry from heavy regulation (which is still an option if something market-based doesn't pan out). The reporting approach has already shown success with traditional wireless and phone outages, which became significantly more reliable once reporting outages to the FCC became mandatory. This could also be a harbinger for how the administration approaches cybersecurity in other critical infrastructure industries like electrical utilities and banking.
