Matthew R. Fogt actively works with the firm’s land use, real estate, environment, natural resource and energy practice groups. He also works with a broad range of asset types, including master-planned communities, renewable energy facilities, mixed-use projects, airports, resource extraction, hospitality properties, agriculture, as well as office, industrial, multi-family and retail properties. The breadth of Matthew’s expertise provides unique efficiency and value to clients in that he routinely performs work typically done by two or more separate attorneys.

Within the land use realm, Matthew regularly obtains development approvals from various local, state and federal agencies, performs entitlement and zoning review as part of acquisitions, navigates projects through the California Environmental Quality Act and the National Environmental Policy Act, processes subdivision maps, advises regarding redevelopment issues, including prevailing wage, arranges public finance, including community facilities districts, advises regarding affordable housing, and negotiates complex conservation easements and development agreements.

Within the real estate realm, Matthew regularly handles the following transactions: purchase and sale, debt and equity financing, public finance, leasing, utility agreements, master developer representation, easements, Department of Real Estate and owners’ associations, title review, construction agreements, infrastructure agreements, exactions and fee agreements, consultant agreements, construction defect, and eminent domain.

In addition to general land use and real estate matters, Matthew also regularly advises regarding renewable energy projects, utility rights-of-way, state and federal resource permits, habitat conservation plans, remediation plans, underground storage tanks, and brownfield development.

Matthew resides in Irvine with his wife and five children. He volunteers with the Boy Scouts of America and his church's youth program and coaches soccer, football and softball.

Chris Payne

Chris Payne is a Managing Director for SARES•REGIS Group, a vertically-integrated real estate investment company focused on developing, redeveloping, acquiring, and managing apartment communities and commercial properties throughout the Western United States. Mr. Payne oversees the residential platform with direct responsibility for new development activity as well as oversight of the investment, construction, and property management divisions.

With over 20 years of experience in the residential industry, Mr. Payne has developed many residential product types including apartments, condominiums, seniors, single family, and affordable housing. Prior to joining SARES•REGIS Group, Mr. Payne managed the regional development activities for AvalonBay Communities in Southern California for 14 years. There he was responsible for multi-family development activity totaling over $1.5 billion dollars. Prior to joining AvalonBay, Mr. Payne managed new development activity in Southern California for Belmont Corp, a national provider of senior's housing and assisted living services. From 1996 - 1998, Mr. Payne was responsible for developing single family home communities with Greystone Homes.

Mr. Payne was awarded a Master of Real Estate Development degree from the University of Southern California in 1996, and a Bachelor of Science degree in Finance from California State University Fullerton in 1991. Mr. Payne currently serves as an adjunct professor at the University of Southern California and is a licensed California Real Estate Broker. His professional affiliations include the Urban Land Institute and National Multi Housing Council.

Samuel Simone

Senior Managing Director

Mill Creek Residential

Sam Simone serves as a Senior Managing Director in the Southern California region for Mill Creek Residential. In this role, Sam is responsible for pursuing new development opportunities, product design, and the pursuit of entitlements to meet all local jurisdictional requirements.

Prior to this position with Mill Creek, Sam was a Managing Director in the company's Mid-Atlantic region, where he oversaw the development of Trilogy NoMa, a 603-unit community in Washington DC. Prior to joining Mill Creek Residential at its formation in August, 2010, Sam served at Trammell Crow Residential for 10 years as a Development Associate and later, Managing Director. Prior to joining Trammell Crow Residential, Sam was a Senior Real Estate Consultant with Arthur Andersen’s Real Estate Consulting Portfolio Services Group in New York City. In this role, Sam’s responsibilities included the management of due diligence and advisory service projects including both single-asset and portfolio real estate acquisitions, financings, depositions; commercial mortgage backed securities transactions (CMBS) valuations and “B-Piece” acquisitions, joint venture analysis valuation, and office and hotel development financial modeling/analysis for investment banks and large institutional investors.

Sam received his Bachelor of Science Degree from the State University of New York in Business Administration/Finance.

Chris Marsh

President, Apartment Development Division

Chris Marsh is President of Irvine Company Apartment Development division. Mr. Marsh is responsible for leading the company’s apartment development growth plan, including land acquisitions, due diligence, entitlements, product development, design, construction and delivery.

Since joining the company in 2003, Mr. Marsh over time has been responsible for overseeing all aspects of development for commercial and residential projects for the company, including office, resort, retail and apartment properties. His achievements include the Resort at Pelican Hill, where he acted as Project Executive in delivering the world-class resort.

Mr. Marsh has practiced in the field of commercial and multifamily real estate development for 25 years and has represented developers in the United States, United Kingdom and Spain. In a consultancy capacity, he also acted as third party adviser to several blue chip and institutional investors, including Société Générale, Scottish Widows and Pearl Assurance.

He received a bachelor’s degree with first-class honors in quantity surveying from the University of Central England, Birmingham, UK, and earned a master’s degree in construction management from the University of Reading, UK.

Mark Grace

Mark Grace, Managing Director, is responsible for new loan origination utilizing direct relationships with Fannie Mae, Freddie Mac, HUD, CMBS, bank, and life insurance companies. Mr. Grace provides financing solutions to commercial real estate developers and owners debt nationally and has over 14 years of experience in commercial real estate lending. Throughout his career, Mr. Grace has procured billions in debt for his clients but remains focused on his clients and delivering exceptional service and flawless execution.

Prior to joining Walker & Dunlop, Mr. Grace was a vice president at NorthMarq Capital. Prior to his production roles, Mark served for eight years underwriting debt and served as the analyst council chairperson in 2009. In his first year as an originator, he was awarded the rookie of the year designation for his notable production.

Mr. Grace earned a dual degree in finance and management information systems from Boston University School of Management and a Master of Business Administration from the University of Southern California’s Marshall School of Business. He is a licensed California real estate salesperson.

Beyond the Company, Mr. Grace is an avid snowboarder, mountain biker, and outdoorsman, spending as much time as possible with his family, clients, and friends in the mountains. He is a father of four and is an active supporter of the Challenged Athletes Foundation
