SBA: 8(a) CHANGES
|

| The SBA is proposing changes to rules for 8(a) companies, including allowing more bids. So says SBA’s Theodore Holloman, who this morning headlined an NVTC B2G Committee event at Patton Boggs in McLean. One thing we learned: 8(a) is not how Canadians tell you how many gold medals they won. |

Theodore’s official title is Washington Metro Area Deputy District Director, which requires us setting up an LLC just to say. He’s above center (nice touch with the vest) with the other panelists: 2020 Company co-founder Haresh Bhungalia, Shipley Associates VP Nancy Kessler, and Albo & Oblon gov guru Seth Berenzweig. Some major proposed changes Theodore pointed out when it comes to joint ventures:
- The “3 in 2” rule that limits companies to bidding on three 8(a) contracts in two years could switch from bids to contract awards.
- The SBA proposes that the 8(a) partner must do at least 40% of the work in the contract, clarifying its previous requirement that an 8(a) does a “significant portion” of the contract.
- 8(a) companies could no longer be required to receive 51% of the profits from the contract, but be in line with the amount of work they do.

Haresh says IDIQs are a great way for small companies to get work while also fighting for 8(a) contracts. And when it comes to employee morale, he says his company invests $1000 per year/employee. (We’re assuming it’s not just a pile of money left on the desk.) Oh, and being 8(a) doesn’t guarantee work: Theodore says 51% of 8(a) firms never get a small business contract during the 9-year program.
